Terms & Conditions

These Terms & Conditions form the agreement between Lil Gym Ltd ("Lil GYM", "we", "our" or "us") and the Member ("you"). By purchasing a membership, you agree to be bound by these Terms & Conditions.

Membership

Membership entitles you to use Lil GYM's facilities, equipment and services appropriate to your membership type during advertised opening hours.

Memberships are personal to the named member and may not be shared, transferred or assigned to another person.

Membership does not guarantee access where the gym has reached its safe operating capacity.

Age Requirements

Members must be 18 years of age or over.

Health

By joining Lil GYM, you agree to the following health declaration:

• I believe I am medically fit to participate in physical exercise.
• I understand that it is my responsibility to ensure I am healthy enough to exercise safely.
• I have discussed with a GP or another suitably qualified healthcare professional, any medical condition, injury or other health concern that may affect my ability to exercise safely, where appropriate.
• If I have any doubts about my health or ability to exercise, I will seek advice from my GP or another suitably qualified healthcare professional before using the gym.
• I will not use the gym if I feel unwell, have been advised not to exercise by a medical professional, or am under the influence of alcohol or recreational drugs.
• If my health or medical circumstances change after joining, I understand that it is my responsibility to seek appropriate medical advice before continuing to exercise.
• If I become pregnant, I understand that I should seek appropriate medical advice before continuing to exercise and will modify my activity accordingly.
• I understand that all forms of exercise involve an element of risk and that I participate voluntarily and at my own risk.

Gym Induction

Lil GYM recommends that all new members complete a gym induction before using the facilities.

Members may choose to decline an induction if they are confident in the safe use of gym equipment. By declining an induction, the member confirms that they are satisfied they know how to use the equipment safely and will only use equipment they understand how to operate correctly.

Members who are unsure how to use any equipment should stop using it immediately and request an induction or assistance from Lil GYM before continuing.

Members may request a gym induction at any time during their membership, subject to availability.

Declining a gym induction does not affect the member's responsibility to exercise safely, comply with the Membership Terms & Conditions and Gym Rules, or complete the Health Declaration.

Access

Your membership provides access only during the published opening hours applicable to your membership type.

Entry is gained using your personal QR code in your member area via the app.

You must never:

• allow another person to enter using your access credentials ("tailgating")
• lend or share your access credentials
• attempt to gain unauthorised entry
• assist anyone else to gain unauthorised entry

Any misuse of the access system may result in immediate suspension or termination of membership.

Male Attendants

Lil GYM is a women-only gym, and membership is restricted to women.

From time to time, male attendants may be present within the gym for legitimate operational purposes. These may include, but are not limited to:

• Essential maintenance, repairs or equipment servicing.
• Cleaning, waste collection or sanitary waste servicing.
• Deliveries or installations.
• Health and safety inspections.
• Inductions or classes led by owner/s of Lil GYM.
• Other circumstances where their presence is reasonably necessary for the operation of the gym.

Where reasonably practicable, Lil GYM will endeavour to carry out maintenance and servicing outside of busy periods and minimise any disruption to members.

By becoming a member of Lil GYM, you acknowledge and accept that male attendants may occasionally be present for these purposes.

Unmanned Facility

Lil GYM operates as an unmanned gym for all or part of its opening hours.

By using the gym, you acknowledge that:

• you may be exercising without staff present
• you are responsible for exercising safely
• a panic button is located within the gym and is for emergency use only
• Pressing the panic button will alert GymSafe who will patrol all CCTV cameras for anyone needing assistance and will call 999 and notify management
• emergency assistance may not be immediately available
• you should carry a mobile phone whenever possible while using the gym

Any accident, injury or equipment fault should be reported to Lil GYM as soon as reasonably possible.

Members are responsible for familiarising themselves with the Safety Information displayed throughout Lil GYM before using the facilities.

Safety & Security

Lil GYM is committed to providing a safe and secure environment for all members.

To help achieve this, the gym operates a range of safety and security measures, including but not limited to:

• 24-hour recorded CCTV, which is remotely monitored during unmanned hours.
• Personal member access credentials to control entry into the gym.
• Emergency panic buttons linked to our remote monitoring provider.
• A first aid kit available within the gym.
• Fire detection and alarm systems.
• Clearly marked emergency exits and evacuation procedures.

Members must:

• Use only their own authorised access credentials and never allow another person to enter using their membership.
• Familiarise themselves with the location of emergency exits, first aid equipment and emergency procedures before using the gym.
• Report any accident, injury, security concern or damaged equipment to Lil GYM before leaving the gym.
• Follow all emergency instructions given by Lil GYM, the emergency services or our appointed monitoring provider.

Lil GYM reserves the right to update its safety and security arrangements from time to time to improve the safety and security of members and the premises.

Gym Rules

Members agree to:

• Treat all members, visitors and staff with courtesy and respect at all times.
• Use equipment only for its intended purpose and in accordance with any instructions provided.
• Return all equipment to its designated storage area after use.
• Wipe down equipment after use where cleaning products are provided.
• Wear suitable gym clothing and clean, enclosed footwear at all times. Bare feet, socks only, sandals, flip-flops or open-toed footwear are not permitted, except where instructed during specific classes such as Yoga & Pilates.
• Avoid behaviour that may intimidate, harass or disturb other members.
• Keep noise to a reasonable level and comply with the Music & Audio Policy.
• Report any damaged or faulty equipment immediately.
• Follow all safety notices, policies and reasonable instructions issued by Lil GYM.

Lil GYM reserves the right to refuse entry or suspend or terminate membership where a member's behaviour is unsafe, abusive or otherwise breaches these Terms & Conditions.

Music & Audio Policy

To help keep membership costs as low as possible, Lil GYM does not provide background music within the gym.

As there are residential properties above the premises, we also ask members to help minimise unnecessary noise out of consideration for our neighbours.

Members are welcome to listen to their own music, podcasts, videos or other audio content while using the facilities, subject to the following conditions:

• Music, podcasts, videos (including YouTube), television programmes, films and any other audio content may only be listened to through personal earphones or headphones and must not be audible to other members.
• The volume should be kept at a level that allows members to remain aware of their surroundings and any emergency announcements.

Playing audible music or other copyrighted audio within the gym may breach music licensing requirements and could expose Lil GYM to additional licensing costs or financial penalties.

Where a member's actions result in Lil GYM incurring additional licensing fees, fines or other reasonable costs, Lil GYM reserves the right to recover those costs from the member responsible.

Licence-free music may be played by Lil GYM during instructor-led classes where appropriate.

Members who fail to comply with this policy will be asked to stop playing the audio immediately and may result in suspension or termination of membership in accordance with the Membership Terms & Conditions.

Classes

Members are responsible for ensuring they are fit to participate in any class and should exercise within their own ability.

Before the start of each class, members must inform the instructor of any injury, medical condition, pregnancy or other circumstance that may affect their ability to participate safely.

Members should immediately stop exercising and notify the instructor if they experience pain, dizziness, illness or any other concerning symptoms during a class.

To help improve technique and reduce the risk of injury, instructors may occasionally provide hands-on guidance or gentle physical adjustments where appropriate. This may include correcting posture or movement patterns. If you would prefer not to receive hands-on guidance, please inform the instructor before the class begins, and your preference will always be respected.

Some classes, including Yoga, may occasionally include a brief guided relaxation incorporating a gentle head or shoulder massage. Participation is entirely optional, and members may decline at any time by informing the instructor.

Some classes, including Yoga, may also occasionally involve the use of essential oils or aromatherapy products to enhance the class experience. Members must inform the instructor before the class begins if they have any allergies, sensitivities, asthma or other medical conditions that may be affected by these products. Lil GYM will endeavour to accommodate such needs where reasonably practicable but cannot guarantee an essential oil-free environment.

Lil GYM reserves the right to refuse participation in a class where it believes it would be unsafe for a member to take part.

Lockers & Personal Property

Lockers are provided for temporary use while using the gym.

All lockers must be emptied before leaving.

Lil GYM reserves the right to open lockers left in use after closing or where necessary for security reasons.

Members leave all personal belongings at their own risk.

Lil GYM accepts no responsibility for loss, theft or damage to personal property unless caused by our negligence.

Lost property will normally be retained for up to 14 days before being donated, recycled or disposed of.

CCTV

CCTV operates throughout the gym for the purpose of crime detection, prevention, public safety, and to protect staff and premises.

By entering the premises, you acknowledge that CCTV recording and monitoring is in operation.

Membership Fees

Membership fees are payable in advance.

Monthly and annual memberships renew automatically until cancelled in accordance with the Membership Cancellation Policy.

Payments are collected by our authorised payment provider.

Members remain responsible for ensuring sufficient funds are available on the payment date.

Refunds

Membership fees, joining fees and other charges are non-refundable except where required by law or where Lil GYM agrees otherwise at its sole discretion.

Refunds will not be provided for:

• Non-attendance or unused membership time.
• Illness or injury (unless otherwise required by law).
• Holidays, work commitments or changes in personal circumstances.
• Failure to cancel membership in accordance with the Membership Cancellation Policy.
• Temporary closure of the gym for maintenance, repairs or circumstances beyond our reasonable control where membership access is reasonably maintained.

If Lil GYM is unable to provide the membership services for an extended period due to circumstances within our control, we may, at our discretion, offer an extension of membership, a credit to the member's account, or a partial refund.

Nothing in this policy affects your statutory rights under UK consumer law.

Failed Payments

If a payment fails, we will attempt to collect payment again.

Any reasonable administration or collection costs incurred may be added to the outstanding balance.

Lil GYM reserves the right to suspend access until outstanding payments have been received.

Persistent non-payment may result in the debt being referred to a third-party debt recovery agency.

Membership Freezes

Members may request to temporarily freeze their membership, subject to the following terms:

Freeze Period:

• The minimum freeze period is 30 consecutive days.
• The maximum freeze period is 90 consecutive days per request.
• Freeze requests must be submitted using the official freeze request form.
• Freeze requests must be submitted at least 7 days before your next membership payment date. Requests received after this time may take effect from the following billing cycle.

Eligible Reasons memberships may be frozen:

• Injury or illness
• Pregnancy
• Redundancy
• Other exceptional circumstances at Lil GYM's discretion

Lil GYM reserves the right to request supporting evidence where appropriate.

Freeze Charges:

• Approved freeze requests for an eligible reason listed above will incur an administration fee of £5 per month.
• Freeze requests approved for any other reason will incur a charge of 50% of the normal monthly membership fee for each month of the approved freeze.

During Your Freeze:

• Gym access is suspended throughout the freeze period.
• Your membership will automatically reactivate at the end of the approved freeze, and normal payments will resume on your usual billing date.
• You may give notice to cancel during a freeze, however the standard 30 days' notice before your next renewal date will still apply.

Additional Information:

• Promotional and Founding Member rates will not be retained following a membership freeze and will revert to the current standard membership price.
• Lil GYM reserves the right to approve or decline any freeze request.
• Membership freeze requests may be suspended or refused if Lil GYM has reached full membership capacity or is operating a waiting list.

By submitting a freeze request, you confirm that you have read and agree to this Membership Freeze Policy.

Membership Cancellation

Members may cancel their membership at any time, subject to the following terms:

Notice Required:

• Memberships may be cancelled outside of any contract period by providing at least 30 days' notice before the next renewal date.
• Notice must be submitted using the official cancellation request form or by emailing Lil GYM.
• Membership fees remain payable throughout the notice period.
• Flexible memberships may be cancelled anytime with no notice required.

Gym Access:

• Members will continue to have full access to the gym until the end of their paid membership period.
• Access will automatically end once the membership has expired.

Outstanding Payments:

• Any outstanding membership fees or charges must be paid before the membership is cancelled.
• Failed or missed Direct Debit payments may be referred to our Direct Debit collection provider and may incur additional charges.

Rejoining:

• Members are welcome to rejoin at any time, subject to availability.
• Any promotional, introductory or Founding Member rates will not be reinstated, and the current membership prices will apply.

Membership Freeze:

• Members may submit their cancellation notice while their membership is frozen.
• The standard 30 days' notice before the next renewal date will still apply.

14-Day Cooling-Off Period:

If you purchase your membership online, you have the right to cancel your membership within 14 days of the date of purchase in accordance with the Consumer Contracts Regulations 2013.

If You Have Not Used Your Membership

If you cancel within the 14-day cooling-off period and have not accessed the gym, you will receive a refund of any membership fees paid.

Please note that the £15 joining fee is non-refundable once your membership has been activated, as it covers Membership administration, Access setup, Processing fees, Direct Debit / payment set up, Insurance and compliance administration, and Customer support.

If You Have Used Your Membership

By accessing the gym during the 14-day cooling-off period, you expressly request that your membership begins immediately.

If you subsequently cancel within the cooling-off period, Lil GYM will refund any remaining membership fees paid after deducting:

• The non-refundable £15 joining fee.
• The published Lil GYM day pass rate for each day the gym has been accessed.
• Any reasonable payment processing or transaction fees incurred by Lil GYM.

Any remaining balance will be refunded using the original payment method.

Nothing in this policy affects your statutory rights under UK consumer law.

Discretion:

• Lil GYM reserves the right to amend this policy where necessary.
• Lil GYM may terminate a membership immediately where a member breaches the Membership Terms & Conditions or behaves in a manner that places others at risk or is abusive, threatening or otherwise unacceptable.

By submitting a cancellation request, you confirm that you have read and agree to these Terms & Conditions.

Price Changes

Membership prices may be reviewed periodically.

Unless your membership states otherwise, memberships will increase annually on 1^st January by 5% or the rate of inflation, whichever is higher.

Lil GYM reserves the right to review and amend membership prices at other times where reasonably necessary. Any additional price changes will be communicated with at least 30 days' written notice before taking effect.

If you do not wish to accept a price increase outside of the annual increase, you may cancel your membership in accordance with the Membership Cancellation Policy before the new price takes effect.

Temporary Closure

Lil GYM may occasionally need to close or restrict access for maintenance, repairs, cleaning, emergencies, public health requirements or circumstances beyond our reasonable control.

Where reasonable, we will provide advance notice.

Such closures do not automatically entitle members to refunds or extensions unless required by law or at Lil GYM's discretion.

Liability

Members use the gym and its equipment entirely at their own risk.

Nothing within these Terms excludes or limits Lil GYM's liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded.

Subject to the above, Lil GYM shall not be responsible for any injury, loss or damage arising from misuse of equipment, failure to book or undergo an induction, failure to follow safety instructions or use of the facilities beyond a member's own capabilities.

Members are responsible for any damage they deliberately or negligently cause to Lil GYM’s property.

Photography & Social Media

From time-to-time Lil GYM may take photographs or videos for promotional purposes.

If you do not wish to appear in promotional material, please notify us in writing.

Members must respect the privacy of others and must not photograph or film other members without their express consent.

Privacy

Lil GYM processes personal data in accordance with UK data protection legislation.

Please refer to our Privacy Policy for further information.

Changes to these Terms

Lil GYM reserves the right to amend these Terms & Conditions where reasonably necessary.

Any significant changes will be communicated using the contact details held on your membership account.

All updates will appear on our website at www.lilgym.co.uk for member’s viewing.
